Terms of service

These Terms of Service (“Terms”) govern access to viralgrab.com and purchases from ViralGrab, a brand operated by Nigelco LLC (“ViralGrab,” “we,” “us,” or “our”). By visiting the site, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the site.

1. Eligibility and lawful use

You must be at least the age of majority in your jurisdiction, or use the site with the consent and supervision of a parent or legal guardian. You may use the site only for lawful personal or business purposes and in compliance with applicable law.

2. Store information

We try to present product descriptions, photographs, dimensions, colors, compatibility, availability, pricing, and delivery information accurately. Device displays, production variations, measurement methods, and updates can cause minor differences. If information is materially inaccurate, the remedies in our Return and Refund Policy apply.

We may correct typographical errors, update information, limit quantities, discontinue items, or cancel an order affected by an obvious pricing or availability error. If we cancel a paid order, we will refund the affected amount.

3. Orders and acceptance

An order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily mean the order has been accepted. We may decline or cancel an order for lawful reasons, including suspected fraud, payment failure, inventory unavailability, shipping restrictions, inaccurate information, resale activity, or an obvious error. We may request reasonable verification before accepting or fulfilling an order.

You agree that all checkout information is current and accurate and that you are authorized to use the payment method provided.

4. Prices, payment, taxes, and promotions

Prices are shown in the currency displayed at checkout and can change without notice before an order is placed. Applicable taxes, shipping charges, discounts, and duties are calculated or disclosed at checkout when available. Promotional codes are subject to their stated terms, cannot be redeemed for cash, and may not be combined unless expressly permitted.

5. Shipping, delays, and delivery

Processing times, delivery estimates, split shipments, tracking, address responsibility, and delay procedures are described in our Shipping Policy. Delivery dates are estimates unless expressly guaranteed in writing for the purchased service. If we cannot ship within the time promised, we will provide any delay notice, cancellation option, or refund required by applicable law.

6. Returns, refunds, and cancellations

Eligibility, exclusions, claim evidence, cancellation timing, and refund processing are governed by our Return and Refund Policy, which forms part of these Terms.

7. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly if you believe an account has been accessed without permission. We may suspend or terminate an account used fraudulently, unlawfully, abusively, or in material violation of these Terms.

8. Product use and safety

Read and follow all product instructions, labels, warnings, age guidance, care directions, compatibility requirements, and local rules. Do not use a product in a way that is unsafe, unlawful, or contrary to the manufacturer’s instructions. Product information on this site is not medical, legal, financial, or other professional advice.

9. Intellectual property

The site and its original design, text, graphics, logos, photographs, video, software, and arrangement are owned by or licensed to Nigelco LLC and are protected by applicable intellectual-property laws. You may access the site for personal, noncommercial use. You may not copy, scrape, republish, sell, reverse engineer, remove notices from, or commercially exploit site content without written permission, except where law permits.

10. Reviews, messages, and other submissions

If you submit a review, image, comment, suggestion, or other content, you represent that you have the right to submit it and that it is accurate, lawful, non-confidential, and does not infringe another person’s rights. You grant us a worldwide, nonexclusive, royalty-free license to host, reproduce, adapt, publish, and display the submission in connection with operating and promoting ViralGrab, subject to our Privacy Policy and applicable law. We may moderate or remove submissions but do not promise to do so.

Reviews must reflect genuine experiences. Incentivized content, if accepted, must be disclosed clearly. We do not permit fake reviews, harassment, illegal content, personal data posted without consent, or undisclosed commercial promotion.

11. Prohibited conduct

You may not interfere with site security or operation; introduce malware; scrape or automate access in a manner that burdens the service; impersonate another person; attempt unauthorized access; use the site to violate law or third-party rights; submit false orders or payment information; or use content or customer information for unauthorized solicitation.

12. Third-party services and links

The store is hosted by Shopify and may use payment processors, carriers, analytics providers, communication services, and other vendors. Third-party sites and services have their own terms and privacy practices. A link or integration does not constitute an endorsement, and we are not responsible for third-party content or conduct beyond responsibilities imposed by law.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy. By using the site, you acknowledge that policy and the lawful processing necessary to provide the requested services.

14. Disclaimers

To the fullest extent permitted by law, the site and its general content are provided “as is” and “as available.” We do not warrant uninterrupted or error-free access. Any product warranty expressly included with a product remains governed by its stated terms. We do not exclude warranties, guarantees, or remedies that cannot be excluded under applicable law.

15. Limitation of liability

To the fullest extent permitted by law, Nigelco LLC, the ViralGrab brand, and their owners, personnel, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages, or loss of profits or data, arising from site use or a purchase. Where liability cannot be excluded, aggregate liability will not exceed the amount paid for the product or service giving rise to the claim. These limits do not apply where prohibited by law, including liability that cannot legally be limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Nigelco LLC and ViralGrab harmless from third-party claims and reasonable costs arising from your unlawful conduct, misuse of the site, violation of these Terms, or infringement of another party’s rights.

17. Changes, suspension, and termination

We may update the site or these Terms prospectively. Material changes will be posted with a revised effective date and, when required, additional notice. Terms in effect when an order was placed continue to govern that order unless law requires otherwise. We may suspend or discontinue site functions, but doing so does not remove obligations for accepted orders.

18. Governing law and disputes

These Terms are governed by the laws of the State of Minnesota and applicable federal law, without regard to conflict-of-law rules, except to the extent the law where you live provides non-waivable protections. Before filing a formal claim, please contact us and allow a reasonable opportunity to resolve the issue. Nothing in these Terms prevents either party from using an available small-claims process or reporting a concern to a government agency.

19. General terms

If a provision is unlawful or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the policies referenced here are the entire agreement regarding the site and purchases, except for product-specific terms presented before checkout.
